Turning off the heating - defend their rights
Wherever a person lives, he tries to surround himself with comfort - a warm home, high-quality decoration, and modern furniture. But if home improvement depends on the landlord, then heating and hot water are the responsibility of the all-powerful housing and communal services. Turning off the heating in winter or, on the contrary, incandescent batteries during a prolonged thaw suggest an idea of individual convenience.
Local catastrophe
In late spring? the beginning of summer, and maybe in the hottest month, and somewhere in the fall, but sometimes in the winter with a sense of deep doom you discover - they turned off the hot water. Why this happens and whether this phenomenon has any legitimate reason will be interesting for everyone to know.

A little later in 2006, the Rules for the provision of public utilities were legalized, which provide for turning off the hot water, depending on the situation:
- Objective reasons may be natural phenomena. - a storm, a flood, a tornado, against whose destructive power it would be foolish to be indignant.
- Be sure to turn off the heating malicious payers. This procedure is preceded by a written notice giving 1 month to pay off the debt. When the incomplete payment of utilities, which contributes to a steady increase in debt, reaches the figure of 6 monthly payments, it is time to disconnect.
- There are cases when heating devices do not belong to the joint house property. Then, an individual has the right to dismantle radiators in his apartment without violating the regulations and not coordinating his actions with the responsible authorities.
- In accordance with clause 80 of the above Rules, the remaining conditions for switching off the heating include emergency situations, scheduled and preventive maintenance (no more than 2 weeks). On the beginning and duration of the repair tenants are notified in advance by utilities.
- This is followed by "circumcision", the culprit of which could be the consumer himself.. The technical capabilities of in-house engineering systems can be impaired by tenants using household equipment with increased power. Brave people who dare to break the rules for switching off the heating and unauthorizedly disconnect from the general communications face a fine or even eviction.
The heating circuit of a house is considered the property of this building, for which the owner, the housing society or the local government is responsible. The loss of one apartment from the system already violates the integrity of the heating system and the reduction of household property. This explains why the heating is not turned off and only the local government / owner can allow it.
We are going with the spirit
With the absence of hot water, the order disappears and the life of the inhabitants of high-rise buildings turns into a quiet communal hell. The payment for heating is a special article causing unjustified indignation - it barely reaches the minimum required heat is paid “to the full extent”.
The individual heating of one apartment / porch / house once and for all will help to get rid of the problem of “turning off the heating where to call”.
On the one hand, the Law of the Russian Federation of 2010 No. 190 p. 15 prohibits the use of individual sources of heat supply, on the other hand, by Decree No. 307 of April 16, 2012, paragraph 15, if there are technical possibilities, this is realistic. The main thing is not to confuse yourself with specific terminology or incorrect interpretation of legislative acts.
For example, an official may convince you that the situation does not fit into the norms for switching off the heating, losing sight of paragraph 44 of the Ordinance. It deals with the restrictions on the use of certain heating devices when constructing individual heating, which, therefore, is permitted.
By prohibited means gas heaters that must meet such requirements as the presence of a sealed combustion chamber, protection when the fuel supply is interrupted, smoke removal, etc. (See also the article Household gas heating boilers: features.)

Before you turn off the heating in the apartment, you must collect a convincing evidence base:
- scrupulously fix the temperature in the apartment for about a month and certify with the signatures of 2-3 witnesses;
- annoy public services with invitations to go home and draw up acts (water wears away a stone);
- write an application addressed to the head of the housing department, to local authorities, keeping copies to yourself;
- enlist legal support and personal patience.
Note! To top it all you have to insulate your apartment. Any commission (and it will be) must understand that the reason for the low temperature is not your mismanagement, but low-quality heating.

The question of individual heating can be solved individually or collectively, for example, by an entrance or a house.
It is necessary to collect documents such as:
- Statement of reorganization.
- Technical passport of the room.
- Proof of ownership of housing.
- Housing conversion project.
- Written consent of family members, neighbors.
- Conclusion issued by the agencies for the protection of monuments and architecture.
The instruction provides for a period of 45 calendar days during which the local government must make a verdict - it will be the basis for the reorganization of your home. Therefore, the dismantling of the general circuit should be carried out by specialists with their own hands. They will be responsible for the integrity of the heating system, which is part of the common property of the house. Refusal from the central office and the resulting material costs, including legal fees, will pay off for a maximum of two heating seasons. The price for the passed bureaucratic circles of hell will be worth it - your warmth will always be with you.

Individual heating is a very controversial topic and a wealth of experience has already been accumulated by predecessors who managed to fulfill their dream.
